Hi there,

somebody told me about that photographer, who is using my photos for advertising his photography - classical art theft. He is from chile. What would you do? I think he does photography as well but is using my pictures and saying that it's his work:

What would you do to make him stop? Have you tried to hire a lawer in those cases?

I've had a similar situation but it wasn't photography... we sent him an email and told him that we knew and that if he didn't remove the work from his website in 3 days that we would hire a lawyer.

he did end up removing the pieces from his website and emailed back an apology immediately.

however, i see you have all your stuff copyrighted so you have every right to hire a lawyer and sue him for any profit he's made since he's been using those pictures from what i understand. (not that he's made much by his facebook business. lol)

ja, so was ist Mist. Auch ich bin schon das eine oder andere Mal "beklaut" worden.

Leider kann man echt nichts machen, wenn man nicht die Zeit und Muße hat, sich einen teuren Anwalt zu nehmen. Ein Prozess dauert Monate, und man muß erstmal Geld vorstrecken. Dabei ist es egal, ob der Dien übersee sitzt oder nicht. Ich habe da meine Erfahrungen, nur auf so einen Stress laß ich mich nicht mehr ein... lange Geschichte.

Das einzige was hilft, ist hier, und auch auf anderen Seiten darauf aufmerksam machen, so dass 1000nde von Leuten beim Dieb aufschlagen, und ihn darauf hinweisen, dass es illegal und unmoralisch ist. Die meisten schalten dann die Seiten ab, nehmen die Bilder runter oder sonst was... so wie hier in dem Fall. Und schwupps hat man einen Teilerfolg.

Aber leider macht es das Internet möglich, geschütze Bilder zu klauen. Wenn man hinter jedem einzelnen her ist, hat man nicht genug Stunden am Tag. Doofer Spruch: Es ist aber leider wie es ist... traurig!

well, the people here gave you good advices.
just follow them and you can win. but be sure that you can undoubtedly prove that the pics are yours.

This has happened to a few people on my watch list, really you need to report them on whatever site they are using and also I would have thought asking them to remove it directly would be an option. Also just by making a journal about it here gets an army of your watchers to also report and make people aware they are stolen images.

I can't use the links so I assume the thief has had their account deactivated? Hope so and good luck.

I am really horrified to read of this again. It has happened a lot before on dA. I think first contact the dA site management to see if they can get some action. They are a big organisations and could certainly help if they wanted to. I'm pleased to see so many people have come up with good advice. Wishing you luck!

You can contact him, Get a lawer as well. But make sure he isn't using them for print and selling as well.

But I always wondered how the law works with these kinds of things. I see graphic designers who Follow tutorials all the time online and then put that work in their portfolio. It's wrong but really whats the difference between that and say A portfolio you did at school during the year?

Im stumped because of his location but have you also tried Tineye? ( Website that tracks images through the web ) you could see where else they have been posted. When you make new pictures add something to them to fight this kind of thing. A logo on the side does not help, Maybe add a Fake logo Tattoo somewhere hard to remove?

Honestly If i ever used a photo of yours for graphic work I would always ask, And It would always be a private project, nothing to make money off of, just portfolio stuff. But plainly ripping your photo off with No artistic purpose to actually use it is just wrong.

Using other peoples work for inspiration is a great thing, i must agree.

I have to keep Tineye in mind. Sometimes I just don't want to search for art thefts just bacause it is so depressing how many there are. Sometimes posted on some websites with languages that I don't speak. That's where it gets really difficult to have the stolen pics removed.

Well in a world where we are at I can see how it it's a bad thing.
But unless they are getting famous for it I wouldn't let it bother you that much.
If this person is in a country faar away just doing his job and looking for support then I don't see a big problem. Because in the end it comes down to his own skill. If he can't replicate the work himself then he will always end up failing. But if he could then it wouldn't be a big deal now would it? Maybe he didn't have the chance to have a beautiful model like yourself to shoot?

I just say watch out for people, But unless they are within your reach and stealing your work chances and customers then I wouldn't bother too much. it just depends on how they are using them.
